terms of service

Article 1 (General Provisions)

  • 1)These baggage storage service terms of use (hereinafter referred to as "these Terms") stipulate the necessary matters regarding the "baggage storage service" (hereinafter referred to as "this service") provided by Basara Holdings Co., Ltd. (hereinafter referred to as "our company").
  • 2)A user of this service (hereinafter referred to as the "User") shall be deemed to have applied for this service and agreed to these Terms and Conditions at the time when he/she fills in his/her name and other necessary information and submits these Terms and Conditions.
  • 3)The User is deemed to have agreed to these Terms and Conditions in advance, and the contents of these Terms and Conditions shall be the contents of the contract between the User and our company regarding the use of this service.
  • 4)Any matters not stipulated in these Terms and Conditions shall be governed by the notices given at the place where the Service is provided, laws and regulations, or general practice.
  • 5)Notwithstanding the provisions of the preceding three paragraphs, the Company may accept applications for special provisions to the extent not contrary to laws and regulations.
  • 6)The Company reserves the right to change these Terms of Use at any time. In such cases, the changed provisions shall come into effect when the User applies to use the Service.

Article 2 (Business Hours)

  • 1)The operating hours of this service shall be the same as the business hours of the location where this service is provided.
  • 2)We will not accept or deliver luggage outside of these hours, and we will not be liable for any damages arising therefrom.

Article 3 (Refusal of Use)

  • 1)The operating hours of this service shall be the same as the business hours of the location where this service is provided.
    • Explosives and other dangerous items, odorous items, unclean items, and other items that may cause damage to other baggage
    • Cash, valuables such as jewels and precious metals, and securities
    • Food, plants, seafood (excluding processed products)
    • Items that are easily spoiled or deteriorated and items that require refrigeration
    • Firearms and swords
    • Any item the movement, distribution, possession, etc. of which is prohibited by law or ordinance
    • When it is deemed that the activity will promote the activities of or contribute to the operation of an organized crime group (hereinafter simply referred to as an "organized crime group") as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (Law No. 77 of 1991; hereinafter referred to as the "Law").
    • Any other content that the Company deems inappropriate for the provision of this service.
  • 2)If a user falls under any of the following categories, he/she may not use this service.
    • When the person is deemed to be an organized crime group, a member of an organized crime group as defined in Article 2, Paragraph 6 of the Law (hereinafter simply referred to as a "member of an organized crime group"), a semi-regular member of an organized crime group, a person related to an organized crime group, or other anti-social forces.
    • When it is recognized that a corporation or other organization whose business activities are controlled by an organized crime group or its members
    • When a corporation has a director who is deemed to be a member of an organized crime group
    • When a person is deemed to be a person who has committed criminal acts such as violence or intimidation or made unjust demands against the Company

Article 4 (Business Hours)

  • 1)When checking in baggage, the User shall pay 800 yen (excluding tax) for each piece as designated by the Company.
  • 2)When the User receives the baggage on or after the day following the day on which the User checked in the baggage, the User shall pay 1,000 yen (excluding tax) per day.
  • 3)Once a user has applied for the Service, the Company shall not provide any refunds, regardless of the reason.

Article 5 (Deposit and Delivery)

  • 1)When checking in their baggage, Users must sign these Terms and Conditions and present one of the following identification documents (passport, driver's license, health insurance card, residence card, student ID, employee ID, My Number card, etc., or other document that the Company accepts as identification) to apply to the Company for use of the Service.
  • 2)We will issue a baggage receipt upon receipt of payment of the service fee.
  • 3)Checked baggage cannot be taken in or out until it is delivered.
  • 4)The User must present the baggage receipt at the time of baggage delivery, and if the Company is unable to verify that the User is the legitimate owner, the baggage will not be delivered to the User.
  • 5)If a late fee is incurred as provided for in Article 4, Paragraph 2 of these Terms and Conditions, we will deliver the baggage after receiving payment of the late fee.
  • 6)Pursuant to the provisions of the preceding article, if the User does not collect the Baggage within seven days counting from the day following the day on which the Company received the Baggage from the User, the User shall be deemed to have waived his/her rights to the Baggage, and the Company shall dispose of the Baggage. In this case, the Company may sell the Baggage, and the proceeds shall be used to cover the fees set forth in Article 4 and other costs required for disposing of the Baggage.

Article 6 (Company Liability for Compensation)

  • 1)Our responsibility for baggage begins when we accept the baggage from you and ends when we deliver the baggage to you.
  • 2)For damages caused by loss or damage to baggage while in our care due to reasons clearly attributable to our company, the liability limit is 100,000 yen per piece of baggage, and we will compensate for the actual amount of loss within the liability limit depending on the degree of loss or damage based on the value of the baggage.
  • 3)The Company shall not be liable for any damages, including loss or damage, resulting from any of the following reasons:
    • Force majeure such as natural disasters
    • Defects or natural wear and tear on baggage
    • Theft that the Company could not foresee
    • When the items listed in Article 3 are included in the baggage
    • Seizure by relevant government agencies under judicial power, etc., or submission as evidence
    • Other reasons beyond the control of our company

Article 7 (User's Liability for Compensation)

If a user causes damage to the Company through intentional or negligent acts or violation of these Terms and Conditions, the user shall compensate for such damage.

Article 8 (Handling of Personal Information)

Any personal information of users and others that we obtain in order to provide this service will be used only for the purpose of carrying out this service and promoting our services.

Article 9 (Language Provisions, Governing Law and Jurisdiction)

  • 1)This Agreement shall be concluded in Japanese, and all contracts between the User and the Company based on these Terms and Conditions shall be governed by the laws of Japan.
  • 2)In the event of any dispute between the User and the Company regarding these Terms and Conditions, the Tokyo District Court shall be the court of first instance with exclusive jurisdiction.
